These General Terms and Conditions of Sale ("Terms") are entered into between:

Duneela Maison is the trade name used by Ilyas KHAN and does not constitute a separate legal entity.

The business address in Paris and the physical return address in Brandérion are separate addresses. Returned goods must not be sent to the Paris business address. The applicable return arrangements and return address will be confirmed to the Customer before any return is made.

 


 

2. PURPOSE

These General Terms and Conditions govern sales made by Duneela Maison to consumers and professionals, including sales through www.duneelamaison.com.

They apply in particular to natural stone and marble products such as bathtubs, washbasins, sinks, tables, trays, tiles, slabs and furniture.

By placing an order, the Customer accepts these Terms.

For consumers, mandatory consumer protection provisions remain applicable even where they are not expressly reproduced in these Terms.

 


 

3. NATURAL STONE CHARACTERISTICS

Natural stone and marble are natural materials.

Each piece may differ in colour, veining, shade, texture, porosity, minor irregularities and other natural characteristics.

Such natural characteristics do not necessarily constitute defects.

Photographs displayed on the website are illustrative and cannot guarantee that every individual piece will be identical.

 


 

4. STANDARD, MADE-TO-ORDER AND CUSTOM PRODUCTS

Some products may be manufactured, prepared or specifically ordered after an order has been placed.

Where a product is genuinely customised or manufactured according to the Customer's specific requirements, the applicable conditions will be indicated before the order is confirmed.

Where applicable law provides an exception to the statutory withdrawal right for goods made to the consumer's specifications or clearly personalised, that exception may apply.

The mere fact that a product is prepared or ordered after purchase does not, by itself, remove the statutory withdrawal right.

 


 

5. PRICES

Prices are displayed on the website in the currency shown during checkout.

Delivery charges are displayed before final order confirmation whenever they can be determined at that stage.

For international sales, additional taxes, duties or formalities may apply depending on the destination country where legally payable by the Customer.

 


 

6. ORDERS

The Customer selects the products they wish to purchase and completes the ordering process offered on the website.

The order becomes final after payment confirmation, subject to applicable law.

Duneela Maison may contact the Customer to confirm information required for manufacturing, delivery or product safety.

 


 

7. HEAVY AND BULKY PRODUCTS

Certain products sold by Duneela Maison are particularly heavy and bulky.

A marble bathtub may weigh approximately 600 kg when empty, depending on the model.

The total operational load after installation can be substantially higher due to water, users, equipment and accessories.

The Customer must take these loads into account before purchase and installation.

 


 

8. STRUCTURAL CAPACITY OF THE BUILDING

Duneela Maison does not carry out structural assessments of the Customer's building and does not guarantee that the floor, slab, beams, foundations or other structural elements can support the product.

Before installing a heavy product, particularly a marble bathtub, the Customer must have the structural capacity and suitability of the building checked by a qualified professional.

This assessment is the responsibility of the Customer and, where applicable, the professional appointed to perform the assessment or installation.

Nothing in these Terms removes mandatory consumer rights.

 


 

9. DELIVERY

Delivery times displayed on the website are indicative unless expressly stated to be guaranteed.

Delivery may be affected by manufacturing conditions, transportation, weather, customs formalities, carriers or other circumstances beyond Duneela Maison's reasonable control.

Where applicable law provides a maximum delivery period or specific rights in case of delay, those provisions remain applicable.

 


 

10. ACCESS AND DELIVERY CONDITIONS

The Customer must ensure that the delivery address permits access by the relevant vehicle and delivery of the product.

For heavy or bulky products, the Customer must check:

  • access width;

  • doors;

  • stairs;

  • lifts;

  • corridors;

  • height or weight restrictions;

  • handling possibilities;

  • capacity of any required equipment.

Where special handling equipment is required, its organisation and cost may be payable by the Customer when not expressly included in the delivery service.

 


 

11. HANDLING AND INSTALLATION

Duneela Maison sells and, depending on the order, organises delivery of the products.

Unless otherwise agreed in writing, Duneela Maison does not provide installation, fixing, fitting or structural assessment of the building.

Where the Customer appoints an independent installer, handler, carrier or other professional, that professional is responsible for the services entrusted to them.

The Customer should have installation carried out by professionals with the skills, equipment and handling capacity appropriate to the weight and dimensions of the product.

 


 

12. SAFETY — MARBLE BATHTUBS

A marble bathtub may weigh approximately 600 kg when empty.

The actual load after filling may be substantially higher.

Before installation, the Customer must in particular:

  1. have the building's load-bearing capacity checked;

  2. check access and handling arrangements;

  3. use equipment suitable for the product's weight;

  4. have the installation performed by appropriately qualified professionals;

  5. follow any technical instructions supplied with the product;

  6. ensure that the bathtub has suitable and stable support.

Duneela Maison does not carry out structural assessments of the Customer's building.

 


 

13. MARBLE WASHBASINS AND SINKS

Washbasins and sinks must be installed on a suitable support appropriate to their weight and configuration.

Supports, fixings and plumbing components must be suitable for the product.

The Customer should have installation carried out by a professional where appropriate skills or equipment are required.

 


 

14. MARBLE TABLES AND FURNITURE

Tables and furniture made of natural stone must be installed on a stable and suitable surface.

The Customer must ensure that the floor and support can accommodate the weight of the furniture.

Handling and movement must be carried out using appropriate equipment.

 


 

15. TILES, SLABS AND STONE SHEETS

Tiles, slabs and stone sheets must be installed on a suitable substrate and in accordance with applicable professional standards.

Duneela Maison does not guarantee the result of installation performed by a third party.

The Customer or their professional installer must check the condition of the substrate, tolerances, dimensions, site conditions and suitability of the material for the intended use before installation.

 


 

16. THIRD-PARTY INSTALLATION

Where an independent professional is responsible for delivery, handling, fitting or installation, Duneela Maison is not responsible for damage exclusively caused by incorrect handling, inappropriate lifting, dropping, incorrect fixing, incorrect installation or unsuitable equipment attributable to that third party.

This provision does not apply where Duneela Maison's liability arises under mandatory law, including where a product defect or fault attributable to Duneela Maison is involved.

 


 

17. USE AND MODIFICATION

The Customer must use the product for its intended purpose and in accordance with the instructions supplied.

Significant modifications, including cutting, drilling, structural alteration or other modification carried out after delivery may affect the product's safety and characteristics.

Duneela Maison shall not be liable for consequences exclusively resulting from modifications or alterations carried out by the Customer or a third party after delivery, subject to mandatory consumer rights.

 


 

18. MAINTENANCE AND NATURAL EVOLUTION OF THE STONE

Natural stone and marble are living natural materials whose surface appearance may change over time and with use.

The level of shine, polishing, colour and surface appearance may change depending in particular on:

  • daily use;

  • repeated contact with water;

  • limescale;

  • humidity;

  • cleaning products;

  • chemical or acidic substances;

  • abrasion;

  • friction;

  • maintenance performed by the Customer;

  • lack of appropriate maintenance.

Duneela Maison does not guarantee that the stone will retain its original level of shine or polish indefinitely after delivery.

A gradual reduction in shine resulting from normal use, maintenance, environmental conditions or the natural ageing of the stone does not, in itself, constitute a lack of conformity.

The Customer must use cleaning products compatible with natural stone and follow any maintenance recommendations provided.

The use of abrasive, acidic, corrosive or incompatible products may damage the surface and may cause loss of shine, staining or changes in the appearance of the marble.

Where necessary, the Customer may have the stone professionally cleaned, polished or restored by a specialist.

These provisions do not affect the Customer's statutory rights where deterioration results from a product defect covered by a statutory guarantee.


 


 

19. STATUTORY WITHDRAWAL RIGHT

For consumers, where the statutory withdrawal right applies, the Customer generally has 14 days from receipt of the product to withdraw from the contract without giving a reason.

The Customer must inform Duneela Maison of the decision to withdraw within the applicable period.

The product must then be returned in accordance with applicable law.

 


 

20. CUSTOMISED PRODUCTS

In accordance with applicable law, the statutory withdrawal right may be excluded for goods made to the consumer's specifications or clearly personalised.

This exclusion applies only where the legal requirements are actually met.

 


 

21. RETURN COSTS FOR HEAVY PRODUCTS

Where the withdrawal right applies, direct return costs may be payable by the Customer where the Customer has been properly informed of this in accordance with applicable law.

Due to the weight and dimensions of certain products, return costs may be substantial.

For information purposes only:

  • Marble bathtub: return transport estimate up to approximately €1,000

  • Marble table: return transport estimate up to approximately €500

These amounts are indicative estimates and are not automatic fixed charges.

The actual cost may vary depending on the delivery address, country, postcode, accessibility, weight, dimensions, required handling equipment and available carrier.

Returned goods must only be sent to the return address communicated by Duneela Maison:

They must not be sent to the business address at 35 rue Montcalm, 75018 Paris.

The Customer should contact Duneela Maison before arranging the return of a heavy or bulky product in order to confirm the return arrangements and applicable return address.

Where the return is due to a lack of conformity or where applicable law requires the seller to bear return costs, such costs will not be charged to the Customer contrary to mandatory legal rights.

 


 

22. CONDITION OF RETURNED GOODS

The Customer must handle and retain the product with reasonable care during the withdrawal period.

In accordance with applicable law, the Customer may be liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

For heavy or fragile products, the Customer must take reasonable precautions to avoid damage during return transportation.

 


 

23. REFUNDS

Where the statutory withdrawal right is validly exercised, Duneela Maison will refund amounts due in accordance with applicable law.

Initial delivery costs will be refunded in accordance with the applicable legal rules.

Additional costs resulting from the Customer choosing a more expensive delivery method than the standard delivery option offered are not necessarily refundable.

 


 

24. TRANSPORT DAMAGE

The Customer should inspect the condition of the package and product upon delivery.

Where apparent damage exists, the Customer should, where possible, make precise reservations with the carrier and retain photographs, packaging and other relevant evidence.

The Customer should also inform Duneela Maison promptly so that the claim can be processed.

These steps do not remove the consumer's statutory rights.

 


 

25. STATUTORY CONFORMITY GUARANTEE

Consumers benefit from the statutory legal guarantee of conformity under the applicable provisions of French consumer law.

Duneela Maison cannot exclude or limit rights arising from this statutory guarantee.

 


 

26. HIDDEN DEFECTS

Consumers also benefit from the statutory warranty relating to hidden defects under the French Civil Code.

 


 

27. LIABILITY — DAMAGE AFTER DELIVERY

Duneela Maison is liable in accordance with applicable law.

After delivery, Duneela Maison shall not be liable for damage, deterioration or accidents resulting exclusively from improper handling, incorrect installation, improper use, modification of the product, inadequate support or building structure, or the intervention of a third party, where such circumstances are attributable to the Customer or a third party and do not result from a product defect or fault attributable to Duneela Maison.

Duneela Maison shall not be liable for damage exclusively resulting from:

  • incorrect installation by a third party;

  • incorrect handling by a third party;

  • modification of the product;

  • improper use;

  • failure to follow safety instructions;

  • inadequate building structure or support where responsibility lies with the Customer or a third party;

  • use of unsuitable lifting equipment by a third party;

  • use of cleaning products incompatible with natural stone;

  • inadequate maintenance;

  • normal wear or natural changes in the appearance of the stone resulting from use.

These limitations apply only to the extent permitted by law.

This limitation does not affect the Customer's statutory rights, including statutory conformity guarantees, hidden-defect warranties and legal rules relating to liability for defective products.

 


 

28. PRODUCT LIABILITY

Legal provisions relating to liability for defective products remain fully applicable.

Nothing in these Terms is intended to exclude or limit mandatory legal liability, including liability for bodily injury caused by a defective product.

 


 

29. INSURANCE

Duneela Maison may maintain appropriate professional insurance for its business activities.

The existence or scope of any insurance does not alter the rights and obligations imposed by law or these Terms.

The Customer is encouraged to provide information and documents useful for reviewing the complaint, including order number, photographs, invoice, description of the issue and carrier correspondence where available.

 


 

31. CONSUMER MEDIATION

In accordance with French consumer law, Duneela Maison will designate a consumer mediator referenced by the CECMC and competent for its business activity.

The mediator's details will be incorporated into these Terms and communicated to consumers before any relevant B2C sale.

The consumer must first have submitted a written complaint to Duneela Maison.

Consumer mediation is free of charge for the consumer under the conditions provided by law.

 


 

32. FORCE MAJEURE

Duneela Maison shall not be liable for delay or failure to perform resulting from an event beyond its reasonable control and meeting the legal requirements for force majeure.

Mandatory consumer rights remain applicable.

 


 

33. PERSONAL DATA

Personal data collected during orders is processed in accordance with Duneela Maison's Privacy Policy available on the website.

 


 

34. GOVERNING LAW

These Terms are governed by French law, subject to mandatory provisions that may apply to consumers under the law of their country of residence.

For consumers residing in another EU Member State, choosing French law does not deprive the consumer of protection provided by mandatory provisions of their country where those provisions apply.

 


 

35. DISPUTE RESOLUTION

In the event of a dispute, the Customer is encouraged to contact Duneela Maison first in order to seek an amicable solution.

Where the legal conditions are met, the consumer may use the consumer mediator designated by Duneela Maison.

If no amicable solution is reached, the dispute may be brought before the competent courts in accordance with applicable jurisdiction rules.

Nothing in these Terms deprives a consumer of their right to access competent courts.

 


 

36. ACCEPTANCE OF THE TERMS

Before confirming an order, the Customer is invited to read these Terms.

Confirmation of the order constitutes acceptance of the Terms applicable to the sale, subject to mandatory legal consumer rights.
